In today’s construction environment ADR (Alternative Dispute Resolution) is becoming more and more prevalent. Most construction contracts now contain provisions for ADR through the use of mediation and arbitration. Formal litigation in most cases, is only an option of last resort. Many state and federal courts now mandate at least one mediation session as a prerequisite to a trial hearing.
